Article 7 of the Code and EU Regulation 2016/679 grant the data subject specific rights, including the right to access their personal data and have it made available in an intelligible form. The data subject also has the right to obtain the updating, rectification (if erroneous), integration (if incomplete), or erasure of data (in the event of unlawful processing), data portability (the right to receive or transmit data to another controller in a structured, commonly used, and machine-readable format), withdrawal of consent (if the legal basis for processing), anonymization, or blocking/restriction of data processed in violation of the law. The data subject has the right to object, for legitimate reasons, to the processing of their data. With regard to the processing of the data provided, should the data subject identify violations of privacy legislation, he or she will have the right to lodge a complaint with the Data Protection Authority. The interested party may exercise his or her rights by making a request to the Data Controller or the Data Processor (including by requesting the latter to receive specific forms).
In the case of simple information requests and for any purpose not covered by a different and specific notice, unless deletion/objection is legitimately requested, the data will be retained only for the period necessary to provide the requested service and, in any case, no longer than 6 months from the last communication from the interested party. The interested party may request at any time that the processing of the data provided be immediately discontinued.
The legal basis for processing, with reference to mere requests for information, is found in the provisions of Article 6 of EU Regulation 2016/679, letter b) and/or in the specific consent of the interested party. With reference to cookies, the legal basis for processing is constituted by the provisions of Articles 13 and 122 of Legislative Decree 196/2003 (as specified in the Provision of the Italian Data Protection Authority dated 8 May 2014) and EU Regulation 2016/679.
